Sears Canada ALLSTAR Mom Contest
RULES & REGULATIONS –2010
1. To enter, commencing March 1, 2010 complete the online entry form on www.newmomconnection.ca . NO PURCHASE NECESSARY. CONTEST CLOSES May 31, 2010.
2. There will be one (1) Grand Prize awarded to one Grand Prize winner consisting of: one (1) year’s cleaning services from Molly Maid. Average value $1440 based on average billing of 1 cleaning per month for one year.(Approximate retail value of Grand Prize: $1,440); Entrants are eligible to win an RESP (Registered Education Savings Plan) prize worth $1,000 CAD from Heritage Education Funds Inc. (Heritage). Heritage is a distributor of education savings plans. An education savings plan cannot be considered registered until the designated beneficiary’s valid Social Insurance Number has been provided to and submitted via Heritage for registration of the plan and unless it is compliant with all applicable laws, including applicable provincial and federal securities statutory laws, regulations and policies . 3. The winning entry form for the Grand Prize will be drawn from all eligible entries on Tuesday, June 15, 2010. The draw will take place at 12:00 p.m. at the Z Retail Marketing Inc. head office in Toronto, Canada. By entering the contest, entrants agree to abide by the contest rules and the decision of the independent contest organization with respect to all aspects of the contest, which are final. The odds of winning the Grand Prize will depend on the number of eligible entries received by the contest closing date of May 31, 2010. All prizes must be accepted as awarded and are not transferable or convertible to cash. Winner must sign form releasing all sponsors and Z Retail Marketing Inc. from any liability relating to the prizes.
4. The winner will be notified by telephone at the time of the draw and arrangements will be made then for delivery/pick-up of the prize. To win, selected entrant must first complete a written declaration confirming compliance with the rules and correctly answer a mathematical skill-testing question to be administered by phone or mail.
5. All entries are the property of Z Retail Marketing Inc. No responsibility will be taken for entries lost, misdirected or delayed. Winner consents to the use of their name and/or photograph, without payment, in any publicity carried out by Z Retail Marketing Inc.
6. For residents of Quebec, any litigation respecting the conduct and awarding of a prize in this contest may be submitted to la Regie des alcools, des courses et des jeux du Quebec.
7. In the event that the exact product is not available, Z Retail Marketing Inc. reserves the right to substitute a product of equal or greater value at their discretion.
8. This contest is subject to all federal, provincial and municipal laws and regulations.
9. Verification of Entries: The validity of any contest entry is subject to verification by the Sponsor. Any Incomplete or fraudulent entries will be rejected. Any entrant or other individual who enters or attempts to enter the Contest in a manner which is contrary to these official Contest rules or which is otherwise disruptive to the proper operation of the Contest or by its nature is unjust to other entrants or potential entrants will be rejected and that entrant or purported entrant will be disqualified. All decisions of the contest judges, who may be employees or independent contractors of the Sponsor, with respect to any and all aspects of the Contest, including without limitation the eligibility or disqualification of entrants or entries, are final and binding without right of appeal. The Sponsor reserve the right to remove photos without prior notice.
10. Other Termination of Contest: The Sponsor reserves the right, in its sole and absolute discretion, to modify, cancel, terminate or suspend the Contest, in whole or in part, in the event of any cause or circumstance, including without limitation any virus, computer bug or unauthorized human intervention or any other cause that is beyond the control of the Sponsor, that could corrupt or affect the administration, security, impartiality or normal course of the Contest.
11. Release and Exclusion of Liability - General. By entering or attempting to enter the Contest, each entrant and/or purported entrant agrees: (i) to release, discharge, and forever hold harmless the Contest Group Entities, and their respective officers, directors, employees, shareholders, agents and other representatives (collectively, the "Releasees") from any and all claims, actions, damages, demands, manner of actions, causes of action, suits, debts, duties, accounts, bonds, covenants, warranties, indemnities, claims over, contracts and liabilities of whatever nature or kind arising out of, or in connection with the entrant's participation or attempted participation in the contest, compliance or non-compliance with these contest rules and acceptance and use of a Category Prize or Grand Prize; and (ii) if selected as a potential Prize winner, to sign the Sponsors' form(s) of declaration and release documentation in this regard before receiving his/her Grand Prize. The Releasees will not be responsible for lost, incomplete, late or misdirected entries or for any failure of the contest website during the Contest Period, or for any technical malfunction or other problems with, any telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software or for any technical problems or traffic congestion on the Internet or at any website, or any combination of the foregoing, and will not be liable for any resulting injury or damage to any person or property arising from, or relating to, that person's or any other person's participation or attempted participation in the Contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws and, should such an attempt be made, the Sponsor reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. (iii) All winners must sign a release form.
12. The contest is open to all residents of Canada, 18 years of age and older, except those employees of Z Retail Marketing Inc., DGA Media Inc., Sears Canada Inc., MOLLY MAID International, Grand Touring Baby Inc., Abbott Nutrition, Nannies International Inc., Church & Dwight Canada, Heritage Education Funds Inc., Ipso-Facto Inc. and their agencies and the independent contest organization or a person who is domiciled with any of them.
